The terms of use of the service
The Service consists of the use of the www.trackspotter.com website (henceforth, the “Site”) to store and reference data related to the location of persons and/or objects (“Positions”).
To use the Service, CONNETTIVA grants the User a personal, non-transferable account identified by a username and password. It is the User’s responsibility to protect the username and password to ensure that nobody else can access the service through his/her account.
The registration of an account represents the tender of a contract between the USER and CONNETTIVA according to the terms described in this document, the Legal Notes and the Privacy Notice.
The registration can be done in Italian or in English by completing the relevant registration form and the subsequent submission of this data to the Service. The Service will send an email to the User to verify the existence of the email address used for registration and to verify the email address is held by the person who submitted the registration form. This email contains an Internet address that belongs to the Service and is to be used to confirm the registration. Once the confirmation has been duly received, the account, to all intents and purposes, will be considered active and the contract agreed.
The information notices relating to the contract are recorded on the Service and are accessible to the User via the account management page that is available to the User once connected to the service. A copy of the contract Legal Notes and the Privacy Notice. shall be sent to the User via email at the same time as the contract is drawn up. A copy of these will also be kept on the Service.
At any time either during or following the registration, the User can change his/her personal data, contractual profile (see the Prices ) section) and the terms of use of personal data by using the registration form or the account management page.
All communication with the User shall be in the language chosen during registration or the one selected from the account management page.
To send Positions to the Service, the User must have access to a GPS receiver that can submit data via the Internet (Tracker). The purchase of the Tracker and the cost related to its use and the submission of data are the responsibility of the User. CONNETTIVA cannot be held responsible for the malfunctioning of the Tracker or the communication infrastructure needed to send the Position to the Service.
To link the Positions sent by the Tracker to the User’s account, the User must register his/her Tracker with the Service in advance. The manner of this registration depends on the type of Tracker. More details are available on the Trackers section of the Site. In some cases, the Service will assign the User an identification code for the Tracker that needs to be inputted into the Tracker itself. It is the User’s responsibility to ensure the safety of this code so that nobody else can send Positions to the Service using the User’s account.
The Service can receive Positions from Trackers listed in the Trackers section of the Site.
The registration of a Tracker results in the creation of a Receiver within the Service.
Accessing the Positions sent by a Tracker to a Receiver can only be done by the User who registered the Tracker and created the Receiver.
The User can associate other Users, at his/her discretion, to one or more of his/her Receivers, assigning to each of these Users, on an individual basis, permission to access the Positions sent to certain Receivers. In addition, the User can define one or more of his/her Receivers as public and then the Positions can be viewed by all Users of the Service.
The User can also allow other Users to send Positions to one or more of his/her Receivers, whether or not these are public.
The User can remove previously assigned permission to visualise Positions at any time.
The User can cancel any Position sent to one of his/her Receivers at any time.
Failure to protect the data related to accounts and the Tracker identification codes can compromise the privacy of the Users of the Service and the persons linked to it. Whenever the method of accessing the Service by one or more Users of the service suggests failure to protect this information, CONNETTIVA reserves the right to take any technical or legal action necessary to protect the privacy of the Users and the correct functioning of the Service. This action may include, but is not limited to, the suspension of the relevant Receivers or the suspension or even termination of the accounts involved.
